Who these terms are for

Eats All Over is for businesses. You must be able to accept these terms on behalf of your restaurant and be of legal age where you live.

"We" and "us" mean All Over Apps. "You" means the business that creates the restaurant's account and the people on its team.

What Eats All Over does

Eats All Over gives each restaurant a website with its menu (at an eatsallover.page address or on its own domain), online orders for delivery, pickup and at the table with a QR code, kitchen screens and printers, the waiter's handheld on their own phone and a dashboard to manage it all.

Your diners pay you: by card in your own Stripe account or at the venue. Eats All Over charges no commission per order and never holds your diners' money. We do not issue invoices or receipts to your diners and we do not deliver orders.

Plans and prices

  • Menu is free: the website with your menu and the QR code on each table to view it, without orders.
  • Eats All Over includes everything for $29 per month per active location, never more than $499 per month in total. The first time a restaurant activates it, it gets a 30-day free trial.

How we charge, how the trial works, how to switch to Menu and refunds are explained in Plans and billing. Prices are in US dollars and do not include taxes.

Your account, your team and your devices

You decide who on your team signs in to the dashboard (as owner or manager) and who uses the kitchen screens and handhelds. Keep sign-in links, pairing codes, handheld links, printer addresses and PINs private, and revoke any device you lose or no longer use.

You are responsible for what is done from your account and your devices.

Your responsibilities as a restaurant

  • The menu, prices, allergen information, opening hours and delivery zones you enter are yours. Check them: the platform shows and applies what you set. The allergen information diners see must be correct under the food laws that apply to you.
  • You are responsible for food safety, for preparing and delivering orders, for your relationship with diners, for the invoices or receipts you give them and for your taxes.
  • Your Stripe account is yours: you are the merchant and Stripe charges its fees to you.
  • For your diners' data you are the controller. Fill in your legal details in the dashboard so your website shows the legal notice and the privacy information, and use the data lawfully.

Acceptable use

You must not:

  • Publish illegal content or use the platform for anything illegal.
  • Abuse the service, for example by overloading it or getting around its limits or plans.
  • Try to break its security or access other restaurants' data.
  • Resell or sublicense the platform without an agreement with us.

We may suspend access when someone breaks these rules or puts the service or other restaurants at risk.

Data and privacy

Your data is yours. We use it only to provide the service to you, as our Privacy Policy explains. For your diners' data we act as your processor under the Data Processing Agreement. Both are part of these terms.

When you close your account, we delete your restaurant's data within 30 days.

Availability and changes

We work to keep Eats All Over available and fast, but we do not guarantee a minimum uptime: it also depends on the internet, your devices and our providers. Keep a way to take orders if your connection goes down.

There may be maintenance windows when the service is not available. We improve the platform all the time and may change its features.

Intellectual property

The platform, its code, its design and its brands belong to All Over Apps. You get a non-exclusive, non-transferable right to use it while your account is active and you follow these terms.

Your content (your restaurant's menu, photos and name) stays yours. You give us the license needed to show it on your website, in the dashboard and on your devices, only to provide the service to you.

Liability

The platform is provided "as is". To the extent the law allows, we are not liable for indirect losses, lost profits or revenue, or problems caused by internet connections, devices, printers or third-party services such as Stripe.

To the extent the law allows, our total liability for any claim is limited to what you paid us in the 12 months before the claim.

Nothing in these terms limits liability that the law does not allow to be limited.

Ending the service

You can close your restaurant's account at any time. We delete its data within 30 days.

We may suspend your account if you do not pay for the plan or if you misuse the platform, with notice whenever possible.

Applicable law

These terms are governed by the laws of the State of New Mexico, United States, without regard to its conflict of law rules. This does not take away rights that the mandatory law of your country gives you.

Changes to these terms

We may update these terms. If the change is important, we tell you by email or in the dashboard with reasonable notice. If you keep using the platform after that, the new terms apply.
